Terms and conditions of sale

The quotation of all D'Ambrosio srl artifacts is made exclusively per piece without any reference to area or volume. The measurements of each manufactured item refer to the maximum overall dimensions of the frame excluding the rebate fins (unless otherwise expressly signed by the orderer). In addition, the quotations of each quote and/or job order do not include assembly, vat and transportation, which remain the responsibility of the orderer. Transportation will be calculated in relation to the latter's geographical location and number of packages.

The goods and/or artifacts covered by this contract are understood to be sold under a RESTRICTED DOMAIN AGREEMENT pursuant to art.1523 of the C.C., i.e., they will remain the property of D'Ambrosio srl until they have been fully paid for, and therefore the orderer is expressly forbidden to sell and/or dispose of them. Failure to pay even a single installment will result in the immediate termination of this contract. D'Ambrosio srl reserves the right to claim the goods and/or artifacts at any time and to withhold previous payments by way of indemnity pursuant to Article 1526 of the Italian Civil Code.

The order is considered formalized when the order form is filled out in its entirety and countersigned for acceptance, together with the payment of the relevant deposit. Any verbal agreement will not be considered valid and operative even if passed on to our collaborators and/or commercial agents. All orders with related conditions of sale are subject to the approval of the company D'Ambrosio srl. Payments must be made exclusively to the company D'Ambrosio srl by bank transfer or directly at its headquarters by check. Any payments made to agents or collaborators of the company D'Ambrosio srl shall not be understood to be recognized traced and accepted, therefore they do not release the buyer from his obligation to pay.

Merchandise travels at the risk of the orderer even with carriage free to destination, so the company D'Ambrosio srl disclaims any responsibility for delays attributable to carriers.

The company D'Ambrosio srl reserves the right to suspend deliveries at any time if changes of any kind occur in the corporate composition, form, structure, or commercial capacity of the buyer, including in the event of protests of securities, suspension of payments, or any difficulty in fulfilling obligations.

It is given to the orderer to modify the order within 5 working days starting from the date of sending. The change will result in both a change in the cost of the window frame and/or item and the delivery time. All changes and/or modifications must be received only and exclusively in writing.

Advertising materials such as the color chart, samples, technical documentation and photos, are for illustrative purposes only as they may present and/or deviate from the finished product.

The company reserves the right to make any changes of a constructive and technical nature that it deems useful and necessary to improve the product, without any obligation to inform third parties, despite the fact that there are ongoing orders for the orderer.

Any complaints should be received directly to the company within 7 days after receipt of the goods, finally photographic documentation is requested for prompt feedback.

Returns will not be accepted unless expressly authorized by the company.

It should be noted that delivery times are approximate and are defined according to processing cycles. It is clarified that having indicative timelines, deliveries are not disputable.

The warranty is valid provided that the products are properly installed and operated according to a suitable routine maintenance cycle.

The company D'Ambrosio Srl will not be held responsible for any delays in delivery of orders, caused by technical difficulties or procurement of components and raw materials supplied by third parties. The company D'Ambrosio Srl reserves the right to extend the delivery time of the order for a duration equal to the permanence of this circumstance, without incurring liability of any kind. Ordering party/purchaser therefore nothing can claim from the company D'Ambrosio Srl by way of compensation.

The reseller who buys and sends an order to the company D'Ambrosio Srl declares that he/she knows all the characteristics of the products and accepts these conditions of sale. These conditions of sale are on the website and attached to the quotations sent by the company D'Ambrosio Srl.
